“The biggest problem is that public healthcare is an afterthought in India,” says advocate Ashok Agarwal, founder-member of the NGO Social Jurist, who has worked on medico-legal cases for the last two decades. “Three fundamental changes are required in the law, and healthcare legislations should be put on the concurrent list. In fact, public health should be a fundamental right and there should be a national law.”
As hospitals are a state subject, the onus is on individual states to mandate good practices at healthcare centres under their jurisdiction. Currently, only Assam has a law mandating free emergency services at all hospitals, private or government.
In other countries like the US, laws such as the Emergency Medical Treatment and Labor Act (EMTALA) require hospitals to accept Medicare (national social insurance) to provide emergency healthcare to anyone needing it, regardless of citizenship, legal status or the ability to pay. The situation in India is a far cry from that.
“People need to make it a parliamentary and public issue. Get the government interested in legislative changes,” says Agarwal. “The current situation is so grave that in many of the cases I deal with, I just come to an agreement with the hospitals concerned, and work on a case-by-case basis. Patients, too, have no choice but to deal with the private sector because most government setups are in an appalling state.”

स्नेहा जिसकी उम्र सिर्फ 20 साल है l जिसकी शादी हुए अभी ज्यादा समय नहीं हुए, स्नेहा का एक 7 महीने का छोटा बच्चा है l स्नेह Orbital tumor की वजह से अपनी दोनों आंखे गवा चुकी है l और वो बहुत तकलीफ मे है l स्नेहा के पति मनोज कुमार ने स्नेह को लेकर कभी इस अस्पताल कभी उस अस्पताल भागदोड करते रहे पर कुछ परिणाम नहीं मिल रहा था l स्नेहा की तकलीफ दिन पे दिन बढती जा रही थी l उसकी आँख रोज़ धीरे धीरे बाहर आती जा रही थी l पर पैसे ना होने कारण मनोज कुमार बहुत मजबूर था और बहुत परेशान भी l धर्मशिला अस्पताल स्नेहा का EWS केटेगरी में इलाज़ करने से इनकार कर रहा था l आज अधिवक्ता अशोक अग्रवाल और डॉ. आर एन दास ख़ास उसके लिए धर्मशिला अस्पताल गए और स्नेहा को भर्ती कराया, आशा है की इलाज़ से वो ठीक हो पायेगी l



Occupancy of beds earmarked for EWS patients in the city's identified private hospitals has gone down by nearly 20% over the last one month. According to Ashok Agarwal, member of EWS quota implementation monitoring committee, occupancy of EWS quota beds in identified private hospitals was 72% on September 17 and 52% on Friday .

18 साल की लक्ष्मी किडनी की मरीज़ है l लक्ष्मी के माता पिता नेपाल से है पर लक्ष्मी का जन्म दिल्ली में ही हुआ और यहाँ उसने आठवी तक पढाई की और उसकी बीमारी की वजह से आगे नहीं पढ़ सकी l लक्ष्मी के पिता लक्ष्मण चौकीदारी की नौकरी करते है, जहा से इनको 7000/- रुपये प्रति माह मिलता है l जब कुछ दिन पहले लक्ष्मी के पिता लक्ष्मी को इलाज़ के लिए सफदरजंग अस्पताल ले गए तो वहा के डॉक्टर ने उनसे कहा की इसके इलाज़ में बहुत खर्चा लगेगा आप की बस की नहीं है l ये बात सुन के लक्ष्मी के पिता ने उसको भगवान् भरोसे घर में बैठा लियाl गरीबी और हालत से मजबूर पिता ने लक्ष्मी के इलाज़ के आस छोड़ दी और लक्ष्मी घर पे बिना इलाज़ के रहने लगी l जिससे उसकी हालत दिन पे दिन बिगडती गयी l कौशल जो लक्ष्मी के पिता जहा काम करते है वही काम करता है, कौशल ने लक्ष्मी के इलाज़ में रूचि दिखाई और 16 अक्टूबर को अधिवक्ता अशोक अग्रवाल से संपर्क किया l तभी लक्ष्मी को गंभीर हालत में साकेत सिटी हॉस्पिटल में EWS के अंतर्गत भर्ती कराया गया l जहा से लक्ष्मी 21 अक्टूबर को डिस्चार्ज हुई l अब उसका इलाज़ साकेत सिटी हॉस्पिटल में चल रहा है l

ना जाने लक्ष्मी की तरह कितने मरीज़ होगे जो गरीबी के कारण भगवान् भरोसे रह जाते है, और उनका इलाज़ रुक जाता है l

पेश मामले में संजू देवी ने अधिवक्ता अशोक अग्रवाल व अधिवक्ता आदित्य अग्रवाल के माध्यम से राजकीय बाल-बालिका माध्यमिक विद्यालय सेक्टर-16 रोहिणी के एक अध्यापक व प्राचार्य के खिलाफ मुकदमा दर्ज कराने की मांग को लेकर अदालत में याचिका दायर की थी। याचिकाकर्ता का कहना था कि उसका बेटा संजय कुमार आठवीं कक्षा का छात्र था। 23 जुलाई को स्कूल से उसे फोन आया कि उसका बेटा बेहोश हो गया है और उसे अस्पताल में भर्ती कराया गया है। वे अस्पताल पहुंचे तो वहां पर उसकी हालत गंभीर थी और उसकी मौत हो गई। महिला को उसके बेटे की कक्षा के कुछ बच्चों ने बताया कि संजय को एक अध्यापक ने पीटा था। जिसकी वजह से ही उसकी हालत गंभीर हुई। मगर, स्कूल प्रबंधन ने इस आरोपों को सिरे से नकार दिया।

Sub: Matter of Great Concern – EWS-Free-Bed occupancy gone down from 70% to 50% in identified private hospitals

Dear Sir, 

 During the last few weeks, it has been noticed that the percentage of EWS-Free-Bed occupancy in the 44 identified private hospitals has gone done from 70% to 50%. On 17.09.2014, the occupancy was 72% and thereafter, it started going down almost every day and as today, the occupancy is 52%. 

·      -In Max Super Specialty Hospital, Shalimar Bagh, out of 15 free-beds, 10 are vacant.
·      -In Dharmshila Hospital & Research Centre, out of 20 free-beds, 18 are vacant.
·      -In Max Balaji Hospital, Patparganj, out of 40 free-beds, 31 are vacant.
·      -In Batra Hospital, out of 50 free-beds, 39 are vacant.
·   -In Flt. Lt. Rajan Dall Hospital (Fortis) Hospital, Vasant Kunj, out of 15 free-beds, 12 are vacant.
·        -In Pushpawati Singhania Research Institute, out of 11 free-beds, 10 are vacant.
·         -In Max Devki Devi Heart & Vascular Institute, Saket, out of 30 free-beds, 25 are vacant.
·         -In Bensups Hospital, out of 14 free-beds, 12 are vacant.
·         -In Rockland Hospital, Dwarka, out of 10 free-beds, 10 are vacant.
·        -  In R.B. Seth Jessa Ram Hospital, out of 9 free-beds, 9 are vacant.
·        - In Jeevan Anmol Hospital, out of 5 free-beds, 4 are vacant.
·         -In Shanti Mukund Hospital, out of 14 free-beds, 11 are vacant. 

One of the major reasons for such unfortunate situation seems to be that the Government Hospitals are not referring many poor patients to these private hospitals though they themselves are facing overcrowding of poor patients. The other reasons may be due to EWS patients not asserting their rights or lack of awareness among them. The Delhi Government has stopped advertising free-beds facilities in the identified private hospitals through TV Channels and FMs which might also have contributed to this situation. Needless to say, barring few hospitals, all the hospitals are reluctant to provide free treatment to EWS patients.

Kindly look into this matter on urgent basis and do the needful.

MYSTERIOUS DEATH OF 8TH CLASS STUDENT IN GOVT SCHOOL – MAGISTRATE ORDERS SHO TO REGISTER FIR & INVESTIGATE



Callousness on the part of the SHO Police Station K.N.Katju Marg, Sector 16, Delhi in refusing to register FIR in the matter of death of 8th Class student Sanjay Kumar of Govt. Co-ed Secondary School, Sector 15 Rohini on 23.07.2014 in the school, allegedly due to being beaten up by the teacher, forced Ms. Sanju Devi mother of the deceased student to move the Metropolitan Magistrate for lodging of FIR and investigation to unearth the truth.


Metropolitan Magistrate Shri Abhilash Malhotra on 21.10.2014 ordered the SHO to register the FIR under appropriate provisions of law and investigate the matter. “In the present case, from the facts and circumstances, it is amply clear that the child has went to the school from his house and was studying till the half session. As per the ATR, the incident has took place at or around 11.20 am. In complaint made to the police station by Sh. Vinod Chaudhary, he has clearly stated that action be taken against the erring authorities. Once a complaint is received in police station, the SHO concerned was duty bound to register the FIR and to conduct an investigation. Whatever has been done by the police in an enquiry was supposed to be done after registration of FIR. The facts of the case clearly show that the death of the child Sanjay Kumar has been caused in suspicious circumstances. The ATR is also silent on the aspect of installation of any CCTV cameras in the school and seizure of DVR. The complaint discloses commission of cognizable offence and I am of the opinion that detailed investigation is required to unearth the truth,” held the Metropolitan Magistrate. Advocates Aditya Agarwal and Ashok Agarwal, appearing for the complainant mother argued that the police under the influence of powerful teachers’ lobby was protecting the culprit which was quite apparent from the fact that the police had not even registered the FIR even after three months from the death of the student under mysterious circumstances. “The police has not been doing its duty honestly as the parents of the deceased student are very poor and helpless,” submitted the lawyers.
