Decide what constitute adequate writing material for students under RTE Act – High Court directed Director of Education Delhi Govt


Delhi High Court (Manmohan J.) today directed the Director of Education, Govt. of NCT of Delhi to take a view as to what constitutes adequate writing material vis-a-vis each student admitted to schools at elementary level run by Government/MCD in terms of Rule 8 of Delhi Right of Children to Free and Compulsory Education Rules, 2011 and place before the Court within 4 weeks.

The Court was hearing a petition by a class III student of NDMC School, Master Satyam Prajapati filed through Adv Ashok Agarwal highlighting that the Government/MCD have not discharged their obligation in terms of Rule 8 of Delhi Right of Children to Free and Compulsory Education Rules, 2011 which entitles every student to get free writing material. It was submitted that NDMC are providing 5 subject notebooks and 1 drawing book per year to the students at elementary level that do not constitute adequate writing material. The petition had also highlighted that there were 4 lakh students studying in 740 primary school run by NDMC and they had not been provided even with 5 notebooks and 1 drawing book in the year 2015-16 which they were getting earlier.

“That though the NDMC in its affidavit has said that in addition to the supply of notebooks, the proposal for providing other writing/stationery materials i.e. pen, pencils, rubber, sharpener etc. in future was also being considered, the things are not clear and therefore, the Director of Education, Govt. of Delhi may be directed to take a decision in this regard so that all students at elementary level both in Govt. and MCDs schools could be benefited”, argued Mr. Agarwal.

Next date of hearing is 25.04.2016.

Nursery Admission Blues - Delhi High Court Order of 05.02.2016 staying Delhi Government order fixing upper age limit of below 4 years for admission of a child in nursery class

Operative part of the High Court order:

“Consequently, till final disposal of the writ petitions, the impugned order dated 18th December, 2015 is stayed. All children above four years of age who are desirous of seeking admission in pre-school/nursery class in the Academic Session 2016-17 shall be entitled to apply for admission on or before 9th February, 2016 till 4.00 p.m. Respondents are directed to ensure that online applications qua EWS/disadvantageous/differently abled students are accepted. Further, the private schools / government schools are directed to accept hard copies of applications of such children as well as children belonging to general category till the date and time specified hereinabove. Applications already filed by the parents of such wards shall be considered by the schools and their points/marks shall be uploaded on or before 12th February, 2016. This Court may mention that the aforesaid directions have been passed as the last date for displaying first list of candidates is 15th February, 2016 and this Court desires that all the parties adhere to the schedule fixed.”


Parents can apply for nursery admission of children above 4 years by February 9 (Tuesday) - Delhi High Court rules today - A great victory of children against the arrogant AAP Govt - Advocates Ashok Agarwal & Khagesh B. Jha argued case for the children.

CAT notices to Union of India, Government of Delhi for relaxation in CTET qualification


Central Administrative Tribunal  , Principal Bench today issued notices to HRD Ministry  Govt. of  India and Govt. of Delhi  on a petition filed by teachers through  Adv Ashok Agarwal  seeking direction to grant relaxation in CTET qualification for purpose of recruitment as Special Educator (Primary) in MCD. CAT has sought responses from HRD Ministry and Govt. of  Delhi within four weeks and matter is listed on 08.03.2016.

As many as 14 teachers namely,  Ms Chhaya  Goswami, Ms Alka   etc had applied for the post  of Special Educator (Primary) in MCD in response to DSSSB advertisement .
 These teachers were not possessing   CTET qualification on the cutoff date but however they acquired such the same after cutoff date and before 31st march 2015.The DSSSB has rejected their selection on the ground that they have acquired CTET qualification after the cutoff date.

Mr Ashok Agarwal appearing for the teachers argued that since these candidates have acquired CTET qualification before 31st March 2015, their cases were required to be considered for relaxation in terms of Section 23 of RTE Act, 2009. “In case such relaxation is granted, the unemployed qualified teachers would get jobs on one hand and the differently abled students would get Special Educators. Presently hundreds of posts of special educators are lying unfilled in state run schools non availability of qualified teachers”, submitted Mr.Agarwal.

Fresh petition by a 4+ age ews student in Delhi High Court against upper age bar Delhi Govt order for nursery class admission - hearing on 05.02.2016

A fresh petition has been filed today in Delhi High Court by 4+ age ews student through Adv Ashok Agarwal challenging the validity of Delhi Govt Order dated 18.12.2015 fixing upper age limit of below 4+ age for admission in Nursery admission. It is submitted that Delhi Government online system is not accepting his application for nursery admission because he is 4+ age. Case is coming up for hearing for 05.02.2016 before Justice Manmohan of Delhi High Court.

Poor patient seeks free treatment of her total Hip replacement surgery in AIIMS - Delhi High Court issue notices to GOI, AIIMS and State of Bihar

Justice Manmohan of Delhi High Court today (02.02.2016) issued notices to GOI, AIIMS and State of Bihar on a petition filed by 35 years old poor patient Asha Devi from Bihar through Advocate Ashok Agarwal seeking directions against the AIIMS to provide her free treatment of total hip replacement surgery. The AIIMS has asked her to deposit Rs. one lakh 27 thousands in the hospital. The poor patient has no money to pay. Family is living in abject poverty. The High Court impleaded State of Bihar in the petition to ascertain as to why the poor patients from Bihar not getting free treatment in Bihar itself and are forced to come Delhi . The High Court passed an interim order directing AIIMS to immediate examine the petitioner and submit the status report on her heath condition before the next date of hearing. Next date of hearing is 19.02.2016.

A family from mathura ( mrs. Geeta Devi 28 yrs and her husband mr. Jagvir 37 yrs.)approached me today . Jagvir was suffering from severe kidney disorder and renal failure .A few months back he got himself treated in Ganga ram hospital . Due to expensive treatment he was forced to sell off his 5 buffaloes @ 50,000 even though he had got help from the PMO office which was around Rs. 3 lakh . Geeta his wife donated the kidney to her husband . The operation was successful . However Geeta needs as much care as her husband does post kidney transplant. Even then their monthly expenditure is amounting to approximately a sum of Rs. 15000 . This family who were working as laborers initially is stranded having sold their land as well as their cattle to save their lives in the capital city .They are neither left with money, nor with any source of income due to their incapacity to work because of their poor health . Both Geet and Jagvir have been referred to SGRH for their further treatment under ews category. Such is the story of the poor and underprivileged suffering from various types of severe and acute diseases in our motherland .
