Delhi Government denies admission to dropout girl student in violation of RTE Act, 2009 - AIPA writes to Delhi LG Najeeb Jung

In a shocking incident , Rajkiya Sarvodaya Kanya Vidyalaya, JJ Colony, Khichadipur, Delhi – 51 (School ID No 1002360) has today denied admission to 13 years old dropout girl student in class VI/VII in utter violation of the provisions of Right of Children to Free and Compulsory Education Act, 2009 (RTE Act, 2009).
Km. Anjali Kanojia, D/o Sunita Devi (Mob – 9871536086), resident of 7/472 Khichadipur Delhi - 110091 was two years back studying in Class IV in MCD School Nagar Nigam Vidyalaya, Block 7, Khichadipur, Delhi-110091. While Anjali was studying, her mother met with an accident due to which her mother could not continue the work of ironing the clothes which was the only source of income. Anjali after dropout of school engaged herself in work of ironing of clothes in order to help her mother financially.
Anjali realizing that without education, her career would be doomed, she stared insisting her mother to get her admitted in government school. Today her mother took her to Rajkiya Sarvodaya Kanya Vidyalaya and met the principal and requested her to grant her admission in class VI/VII as she is about 13 years of age. The principal of the school flatly refused to grant her admission in any class saying that she must produce a school leaving certificate of class V/VI passed. Her mother told the principal that they did not have any document with them but Anjali wants to study. The principal of school was reminded of provisions of RTE Act, 2009, according to which a dropout student is entitled to admission in school in age appropriate class. The principal turned the mother and child out of school saying that she (Principal) has well read the provisions of RTE Act, 2009 and Anjali was not entitled to admission under any of such provisions.
In these circumstances Km. Anjali along with her mother Sunita Devi have personally approached me and requested to help. It is not only unfortunate but also illegal and unconstitutional that Delhi Government run school has denied admission to a dropout girl student who wishes to study.
It is therefore requested that necessary action may be taken in this matter ensuring immediate admission to Km. Anjali Kanojia in class VI/VII, as the case may be, in school Rajkiya Sarvodaya Kanya Vidyalaya, JJ Colony, Khichadipur, Delhi – 51.

DELHI HIGH COURT JUDGMENT OF 17.04.2014 THROUGH JUSTICE MANMOHAN IN GAUCHER DISEASE PATIENT CASE HAS GIVEN HOPES TO LAKHS OF POOR PATIENTS IN INDIA WHO ARE UNABLE TO AFFORD MONEY FOR THEIR TREATMENT IN GOVERNMENT HOSPITALS. I HAD ARGUED BEFORE THE COURT THAT NO GOVERNMENT CAN TAKE THE PLEA OF SCARCITY OF FUNDS TO DENY FREE TREATMENT TO A PATIENT WHO IS UNABLE TO AFFORD THE COST OF THE TREATMENT.

HOW MUCH SCHOOL FEE-HIKE PERMISSIBLE?

It is totally wrong, baseless and incorrect information that the unaided schools are entitled to hike fee every year by 10%. The law is that the fee can be increased or decreased depending upon the actual requirement of a school. 50% of the fee that most of the schools are presently charging is unjustified and unwarranted.

NURSERY ADMISSIONS - MY OPINION - Schools are free to proceed with admission process



Reading of the interim order dated 11.04.2014 of the Hon'ble Supreme Court makes it very clear that Hon'ble Supreme Court has only stayed the operation of the order dated 03.04.2014 of the Division Bench of Delhi High Court resulting in the restoration of the interim order dated 06.03.2014 of the Single Bench of Delhi High Court. In my humble opinion, the schools are free to proceed with the nursery admission process keeping in my mind the interim order dated 06.03.2014 of the Single Judge of the Delhi High Court. It would be totally wrong to read 'stay of the admission process' in the interim order of 11/04/2014 of the Hon'ble Supreme Court.

RIGHT TO HEALTH - GOVERNMENT HOSPITAL MUST PROVIDE FREE TREATMENT TO POOR

अब्दुल रहमान जिसकी उम्र 11  साल है, के दिल में छेद है l ये रामपुर, यूपी का रहने वाला है l अब्दुल रहमान के पिता मोह्हमद सफी अपने बेटे के इलाज़ के लिए  दिल्ली के जी बी पन्त अस्पताल आये l जी बी पन्त में अब्दुल रहमान का इलाज़ शुरु हो गया, पर अस्पताल ने ऑपरेशन के 35 हज़ार रुपये मांगे है, जबकि मोह्हमद सफी बीपीएल कार्ड धारक है l आज मोह्हमद सफी अपने बेटे अब्दुल रहमान के साथ अधिवक्ता अशोक अग्रवाल के दफ्तर में मुफ्त इलाज़ की आशा  लिए हुए आये, अधिवक्ता अशोक अग्रवाल ने इन्हें सलाह दी है की आप एक प्रार्थना पत्र अस्पताल में लगाओ की आपका बच्चे का इलाज़ पूरा फ्री किया जाए l अगर अस्पताल फिर भी फ्री इलाज़ से मना करता है तो कोर्ट में अर्जी लगायेंगे की अब्दुल रहमान को पूरा इलाज़ फ्री दिया जाए

श्री महेंद्र मालाकार (9650281519), आज सुबह 8 बजे अधिवक्ता अशोक अग्रवाल के दफ्तर में अपने तीन बच्चो के साथ उनके स्कूल में दाखिले कराने में सहायता हेतु आये l  उनकी बड़ी लड़की निशु (12 साल) ने नगर निगम प्रतिभा स्कूल, वेस्ट सागर पुर, नयी दिल्ली से इस साल पांचवी कक्षा पास की है l श्री महेंद्र मालाकार ने शिक्षा विभाग के लिए हिंदी में एक प्रार्थना पत्र तैयार किया था l जब निशु से वह पत्र पढने के लिए कहा गया तो वह कुछ भी नहीं पढ पायी l प्रतिभा स्कूल से पांचवी पास किया हुआ बच्चा हिंदी भी नहीं पढ पा रहा है, तो यह समझा जा सकता है बाकी सरकारी स्कूलो में शिक्षा का स्तर क्या है
