Central Administrative Tribunal Principal Bench
today after hearing advocate Ashok Agarwal counsel for the special education
teacher-candidates, has struck down Clause 4 of the HRD Ministry Guidelines dated
8.11.2011 that says, " The condition of passing TET will not be relaxed by
the Central Government". Adv Agarwal had argued that such a clause is in
contravention of Section 23 (2) of the Right to Education Act, 2009.
This Judgment clears the way for CTET/TET
relaxations in teachers’ appointment across the country as all the States &
UTs are now empowered to make a request to the Central Government for CTET/TET
relaxations and the Central Government may consider the same on its own merits.
